1A. P.C. RESOLUTION NO. 2004

Request: A request to amend Section 17.46.060 of the Municipal Code to require every residential property located within an Equestrian (Q) Overlay District to maintain a certain portion of their property as open space, so as not to preclude future possible horse keeping.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, thereby denying the Code Amendment (Case No. ZON2004-00264).

PUBLIC HEARINGS:

2. LOT LINE ADJUSTMENT AND VARIANCE (CASE NOS. SUB2004-00007 AND ZON2004-00480): 30678 Palos Verdes Drive East, 2803 San Ramon Drive and 2809 San Ramon Drive / City-Leimbach-Smith (KF)

Request: A request to allow the adjustment of the property lines between three abutting parcels to eliminate the encroachment of existing improvements for the City-owned Palos Verdes Drive East property upon the privately-owned San Ramon Drive properties.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving the requested Lot Line Adjustment and Variance.

3. REVISION TO HEIGHT VARIATION PERMIT (CASE NO. ZON2004-00366):

3A. CASE NO. ZON2004-00366 (VARIANCE & HEIGHT VARIATION

6512 Nancy Road / Tillman (ES)

Request: A request to revise the approval of ZON2002-00388 that allowed a 3,592 square foot two story addition to the rear of an existing residential structure and a 196 square foot pool cabana on a pad lot that resulted in a 6,802 square foot structure. The revision includes a reduction in the size of the additions from 3,788 square feet to 3,618 square feet, resulting in a 6,632 square foot residential structure with attached garage, and no pool cabana. The project includes extending and maintaining the existing roof ridgeline; and, although the roof ridgeline will not be raised, the resulting overall height of the residence will increase from 30.66-feet to 34.3-feet, which exceeds the 26-foot height limit that may be requested by a Height Variation.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, denying Case No. ZON2004-00366.

4. HEIGHT VARIATION PERMIT (CASE NO. ZON2004-00087): 28129 Ella Road / Anderson (DB)

4A. P.C. RESOLUTION NO. 2004

Request: A request to construct a 1,246 square foot two story addition to an existing 2,282 square foot residence

Recommendation: Staff recommends that the Planning Commission review the revised project and if deemed acceptable, adopt P.C. Resolution No. 2004-__, thereby approving, with conditions, the Height Variation (Case No. ZON2004-00087), as modified.

5. VIEW RESTORATION PERMIT NO. 171: 6100 Arrowroot Lane / Khaligh (JA)

Request: A request to trim and/or remove view-impairing foliage on a property located at 6108 Arrowroot Lane.

Recommendation: Staff recommends that the Planning Commission table the public hearing.

7. HEIGHT VARIATION PERMIT (CASE NO. ZON2003-00174): 3450 Via Campesina / Davis (ES)

7A. P.C. RESOLUTION NO. 2004

Request: A request to construct a 4,946 square foot two-story single-family residence and attached garage, and a 453 square foot detached cabana measuring 12-feet in height, for a structure size total of 5,399 square feet. A total of 879 cubic yards of grading is proposed to accommodate construction of the new residence, which will measure 26-feet in overall height.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving Case No. ZON2003-00174.

NEW BUSINESS:

8. RE-ESTABLISHMENT OF THE VIEW RESTORATION COMMISSION: City / (JR)

Request: A request by Commissioner Karp to consider making a recommendation to the City Council to re-establish the View Restoration Commission (VRC) to hear view cases.

Recommendation: Staff recommends that the Planning Commission discuss Commissioner Karp’s proposal and provide staff with direction.

9. DISCLOSURE OF CC&R'S: City / (JR)

Request: A request by Commissioner Karp to discuss whether to require the disclosure and discussion of CC&R's as part of the Planning Commission’s review of a development application.

Recommendation: Staff recommends that the Planning Commission discuss Commissioner Karp’s proposal and provide staff with direction.
