1. EQUESTRIAN CODE AMENDMENT (CASE NO. ZON2004-00264): City (DB)

1A. P.C. RESOLUTION NO. 2004

Request: A request to amend Section 17.46.060 of the Municipal Code to require every residential property located within an Equestrian (Q) Overlay District to maintain a certain portion of their property as open space, so as not to preclude future possible horse keeping.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, thereby denying the Code Amendment (Case No. ZON2004-00264) that would require all properties in the City’s four Equestrian (Q) Overlay zones to maintain an 800 square foot area for the keeping of large domestic animals.

2. REVISION TO HEIGHT VARIATION PERMIT (CASE NO. ZON2004-00366):

2A. P.C. RESOLUTION NO. 2004 6512 Nancy Road / Tillman (ES)

Request: A request to revise the approval of ZON2002-00388 that allowed a 3,592 square foot two story addition to the rear of an existing residential structure and a 196 square foot pool cabana on a pad lot that resulted in a 6,802 square foot structure. The revision includes a reduction in the size of the additions from 3,788 square feet to 3,618 square feet, resulting in a 6,632 square foot residential structure with attached garage, and no pool cabana. The project includes extending and maintaining the existing roof ridgeline; and, although the roof ridgeline will not be raised, the resulting overall height of the residence will increase from 30.66-feet to 34.3-feet, which exceeds the 26-foot height limit that may be requested by a Height Variation.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving Case No. ZON2004-00366.

3. HEIGHT VARIATION PERMIT (CASE NO. ZON2004-00087): 28129 Ella Road / Anderson (DB)

Request: A request to construct a 1,246 square foot two story addition to an existing 2,282 square foot residence

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, thereby denying Height Variation (Case No. ZON2004-00087).

Request: A request to revise Height Variation No. 884, which was approved on August 24, 1999 for the construction of a new 6,696 square foot two-story residence measuring 25-feet in overall height. Due to an incorrect survey, the new residence was constructed at an unapproved location. Thus, the revision and tract map amendment request is to allow a reduction in the required setback from 15-feet to 5-feet between the existing residence and the trail easement along the rear, thereby allowing the residence to remain in its current location. In addition, the request is to allow two balcony support columns that are greater than 30-inches in height to encroach into the established BGR (building/grading restriction) line.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving Case No. ZON2004-00409 for a revision to Height Variation No. 884, and adopt P.C. Resolution No. 2004-__, recommending approval of Amendment No. 2 of Tract 31617 to the City Council.

Request: A request by the Planning Commission to review the proposed amendments to the Wireless Communications Antenna Development Guidelines (Case No. ZON2004-00345), accept all written and verbal testimony, and make any modifications to the guidelines that the Planning Commission deems appropriate.

Request: A request to construct a 990 square foot addition to an existing 2,484 square foot residence. With the proposed addition, the residence will measure 30’ high, as measured from the lowest grade adjacent to the building foundation/slab (101.35’) to the highest ridgeline of the residence (131.35’), and 20.45’ high, as measured from the highest elevation of existing building pad covered by structure (110.9’) to the highest ridgeline of the residence.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, approving, with conditions, Height Variation (Case No. ZON2004-00566).

9. SITE PLAN REVIEW, VARIANCE, MINOR EXCEPTION PERMIT (CASE NO. ZON2004-00072): 1949 Jaybrook Drive / Escobar (BY)

9B.Exhibit "A"

Request: A request to allow the construction of 520 square foot first story addition at a maximum height of 16.5’, as measured from the point where the lowest foundation meets finished grade (98.2’), and 11.2’, as measured from the highest grade covered by structure (103.5’) to the top of the proposed highest ridge (114.7’). The Variance request is to exempt the property from providing the required two-car garage, and to allow a new front porch to encroach 5’-0" into the required 20’-0" front yard setback. The Minor Exception Permit is to allow the construction of a 120 square foot deck to cantilever 2’-0" over an extreme slope.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving Site Plan Review, Variance, and Extreme Slope Permit (Case No. ZON2004-00072).
