Request: A request to amend the Development Code to regulate the use of Portable On Demand Storage (PODS) containers.

(This item was continued from the September 14, 2004 Planning Commission meeting).

Recommendation: Staff recommends that the Planning Commission recommend to the City Council that they approve the Code Amendment (Case No. ZON2004-00265) to regulate the use of Portable On Demand Storage Containers on private property.

2. CONDITIONAL USE PERMIT NO. 51 – REVISION "D" & COASTAL PERMIT (CASE NO. ZON2004-00402): Seabluff Tract / Seabluff HOA (ES)

2. A P.C. RESOLUTION NO. 2004

Request: A request to modify condition No. 5 of the tract’s conditions of approval. Specifically, the modification is to allow extensions to existing second story rear decks with an overhead trellis above the deck area for the units along Sandy Point and Channel View Courts whose decks do not face the common areas of the Sea Bluff Community. The Sea Bluff tract is located within the City’s Coastal Zone.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving the Conditional Use Permit revision and the Coastal Permit.

3. HEIGHT VARIATION PERMIT (CASE NO. ZON2004-00298): 28016 Beechgate/ Tamhane (DB)

Request: A request to construct a 711 square foot second story addition to an existing 2,339 square foot residence. With the proposed addition, the residence will measure 23.5' high, as measured from the lowest grade adjacent to the building foundation/slab (101.25') to the highest ridgeline of the residence (124.75'), and 22.8' high, as measured from the highest elevation of existing building pad covered by structure (101.95') to the highest ridgeline of the residence.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, thereby approving, with conditions, the Height Variation (Case No. ZON2004-00298).

4. VARIANCE AND GRADING PERMIT (CASE NO. ZON2004-00223): 3705 Hightide Drive / Loo (BY)

Request: A request to allow the grading of 102 cubic yards for the construction of an 814 square foot first story addition and 566 square foot second story addition at a maximum height of 25.37’, as measured from the point where the lowest foundation meets finished grade (94.33’), and 8.20’, as measured from the highest grade covered by structure (111.50’) to the top of the proposed parapet (119.7’). The Variance request is to allow the front addition to encroach 11’-3" into the required 20’-0" front yard setback, maintaining an 8’-9" front yard setback.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, approving with conditions Grading and Variance Permit (Case No. ZON2004-00223).

5. VIEW RESTORATION PERMIT NO. 177: 4132, 4139, and 4140 Exultant Drive / Zabatta, Hoetzel and McConnell (JA)

Request: A request to trim and/or remove foliage located at 4137 Admirable Drive, in order to restore views from 4132, 4139, 4140 Exultant Drive.

Recommendation: Staff recommends that the Planning Commission Adopt P.C. Resolution No. 2004-___, approving VRP No. 177 to trim and/or remove foliage on the property located at 4137 Admirable Drive, in order to restore the applicants’ view from 4132, 4139, 4140 Exultant Drive.
