Commission: COMMENTS FROM THE AUDIENCE (regarding non-agenda items): CONSENT CALENDAR: 1. REVISION TO THE AUGUST 10, 2004 PLANNING COMMISSION MINUTES: City (DB) 1A. PROPOSED CHANGES TO THE APPROVED MINUTES OF AUGUST 10, 2004 Request: A request to amend the August 10, 2004 Planning Commission Minutes to include comments from a resident that were inadvertently left out of the adopted Minutes. Recommendation: Staff recommends that the Planning Commission approve the amendment to the Minutes of the August 10, 2004 Planning Commission meeting. 2. SITE PLAN REVIEW (CASE NO. ZON2004-00550): 6612 Channelview Court / Nelson (KS) Request: A request to construct a 42- inch high entry wall sign with pilasters on both sides for the Sea Bluff Homeowners Association at the southwest corner of Seawolf Drive and Palos Verdes Drive South. Recommendation: Staff recommends that the Planning Commission conditionally approve Case No. ZON2004-00550 for a Site Plan Review application, via Minute Order. 3. AMENDMENT TO HEIGHT VARIATION 884 & CONDITIONS OF APPROVAL OF TRACT 31617 (CASE NO. ZON2004-00409): 6270 Ocean Terrace / Ahamed (ES) Request: A request to revise Height Variation No. 884, which was approved on August 24, 1999 for the construction of a new 6,696 square foot two-story residence measuring 25-feet in overall height. Due to an incorrect survey, the new residence was constructed at an unapproved location. Thus, the revision and tract map amendment request is to allow a reduction in the required setback from 15-feet to 5-feet between the existing residence and the trail easement along the rear, thereby allowing the residence to remain in its current location. In addition, the request is to allow two balcony support columns that are greater than 30-inches in height to encroach into the established BGR (building/grading restriction) line. Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving Case No. ZON2004-00409 for a revision to Height Variation No. 884; and adopt P.C. Resolution No. 2004-__, recommending that the City Council approve Amendment No. 2 to Tract 31617. 4. ONE YEAR TIME EXTENSION OF PARCEL MAP #25896 (CASE NO. SUB2004-00013): Wertheimer (AM) Request: A request to allow a one year time extension for Parcel Map No. 25896. Recommendation: Staff recommends that the Planning Commission Approve the requested 1-year time extension via Minute Order, thereby setting the final expiration date of Tentative Parcel Map No. 25896 as November 28, 2005, with all conditions of approval remaining in full force and effect. CONTINUED BUSINESS: 5. VIEW RESTORATION PERMIT NO. 173: 32653 Seagate Drive, Unit #106 / Trakas (JA) Request: A request to trim and/or remove foliage located at 21 Packet Road, in order to restore the view from 32653 Seagate Drive #106. (This item was continued from the November 23, 2004 Planning Commission meeting) Recommendation: Staff recommends that the Planning Commission accept the applicant’s withdrawal of the permit request. RECESS (approximately 8:30 P.M.) PUBLIC HEARINGS: 6. REVISION TO VARIANCE AND GRADING PERMIT (CASE NO. ZON2004-00542): 2967 Crest Road / Abrishami (ES) Request: A request to revise the approval of Variance No. 482 and Grading Permit No. 2239 that allowed the construction of a 5,931 square foot, split-level, two-story residence (garage included) on a downward sloping lot, with a total of 919 cubic yards of associated grading. The revision includes converting an existing 600 square foot underfloor area under the garage to habitable/usable area, thereby resulting in a 6,531 square foot residential structure with attached garage. No expansions to the footprint or increase in the height of the structure will result from this converted area. Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving Case No. ZON2004-00542 for a revision to Variance No. 482 and Grading Permit No. 2239. 7. HEIGHT VARIATION (CASE NO. ZON2004-00194): 7239 Rue La Fleur / Chang (ES) Request: A request to construct an 888 square foot second story addition to an existing one-story residence, resulting in a 4,456 square foot structure (garage included). The second story addition will be concentrated towards the rear of the residence, and will result in a 24-foot high structure, as measured from adjacent pad elevation to the ridgeline of the new second story. Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, conditionally approving Case No. ZON2004-00194 for a Height Variation permit. 8. CODE AMENDMENT FOR GEOLOGIC DISCLOSURE ORDINANCE (CASE NO. ZON2004-00530): Citywide / City (KF) Request: A City Council-initiated proposal to amend Chapters 15.20, 16.20 and 17.76 of Titles 15 (Buildings and Construction), 16 (Subdivisions) and 17 (Zoning), respectively, of the Rancho Palos Verdes Municipal Code to enact a requirement for disclosure of significant remedial grading, with the purpose of enhancing soil stability or reducing geotechnical hazards, through the recordation of covenants to the title of affected property. As currently proposed, the Geologic Disclosure Ordinance would be triggered by landslide moratorium exclusion requests and proposed subdivisions of land involving remedial grading consisting of either: (1) excavation, fill or combination thereof, in excess of 1,000 cubic yards within any two-year period; or (2) excavation ten feet or more below preconstruction grade or fill ten feet or more above preconstruction grade. Recommendation: Staff recommends that the Planning Commission Review the draft Geologic Disclosure Ordinance, and forward a recommendation of approval to the City Council, via Minute Order.
