Recommendation: Staff recommends that the Planning Commission continue the item to the February 24, 2004 Planning Commission since Commissioner Cote will be absent from this meeting.

2. HEIGHT VARIATION PERMIT AND SITE PLAN REVIEW PERMIT (CASE ZON2003-00253): 30758 Ganado Drive / Galante (RL)

Request: A request to allow the construction of 911 square-feet of additional two-story habitable area towards the front of the existing two-story residential home. The second story additions will measure a maximum height of 22’-4”, as measured from the grade adjacent to the lowest foundation to the top of the roof ridgeline. The applicant is also proposing an additional 165 square-feet of one-story habitable space to the rear of the home under the 16-foot maximum height limit for one-story structures.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, thereby approving, with conditions, the submitted Height Variation and Site Plan Review permit.

3. HEIGHT VARIATION PERMIT (CASE ZON2003-00180): 2043 Beecham Drive / Padilla (BY)

Request: A request to allow the construction of 519 square feet of first story additions and a 902 square foot second story addition. The proposed structure is proposed at a maximum height of 23.87’, as measured from the point where the lowest foundation meets finished grade (104.62’), and 23.17’, as measured from the highest grade covered by structure (105.32’) to the highest ridge (128.49’).

Recommendation: Staff recommends that the Planning Commission identify any issues of concern with the proposed project, provide Staff and/or the applicant with direction in modifying the project, and continue the public hearing to a date certain.

4. APPEAL OF GRADING PERMIT, SITE PLAN REVIEW PERMIT, AND LOT LINE ADJUSTMENT (CASE NO. ZON2003-00349 AND SUB2003-00009): 5251 Rolling Ridge / Slagg (Appellant) (DB)

Request: A request to overturn the Director’s approval of a Grading Permit, Site Plan Review, and Lot Line Adjustment (Case No. ZON2003-00349 and SUB2003-00009), which allows the construction of a 5,482 square foot single family residence, a pool with spa and related equipment to the rear (south side) of the proposed residence, 470 cubic yards of grading, and the reconfiguration of the side property line.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-___; thereby denying the appeal and upholding the Director’s approval of the Grading Permit, Site Plan Review, and Lot Line Adjustment (Case No. ZON2003-00349 and SUB2003-00009)

5. APPEAL OF VIEW PRESERVATION PERMIT NO. 63: 15 Diamonte Lane / Kaye (Appellant) (TN)

Request: An appeal of the Director of Planning, Building and Code Enforcement's approval of a request to trim and/or remove foliage located at 9 Diamonte Lane in order to restore the view from 15 Diamonte Lane

Recommendation: Staff recommends that the Planning Commission adopt PC Resolution No. 2004-__ ; affirming the decision of the Director of Planning, Building & Code Enforcement and approving View Preservation Permit No. 63 upon finding that all applicable findings have been correctly made and all provisions of Section 17.02.040(C)(2) have been complied with.
