1. CODE AMENDMENT (CASE NO. ZON2004-00265): City (DB)

Request: A request to amend the Development Code to regulate the use of cargo containers.

(This item was continued from the September 14, 2004 and November 9, 2004 Planning Commission meetings).

Recommendation: Staff recommends that the Planning Commission continue the proposed Code Amendment (Case No. ZON2004-00265) to the Planning Commission meeting on February 8, 2005.

2. EXTENSION OF CONDITIONAL USE PERMIT NO. 171 (CASE NO. ZON2004-00590): 30057 Matisse Drive / BoatUS-Greenup (KF)

Request: A request to extend the approval of Conditional Use Permit No. 171 for the continued operation of an existing commercial antenna attached to the rear of a single-family residence in the Monaco community. The antenna, which is used to provide emergency assistance to boat owners (similar to the roadside assistance provided to motorists by the Auto Club), was originally approved by the City in September 1992 and has been in continuous operation since that time. The request involves no changes to the use or configuration of the existing antenna.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2005-__, approving a 10-year extension of Conditional Use Permit No. 171 (Case No. ZON2004-00590)

3. VARIANCE, MINOR EXCEPTION PERMIT AND SITE PLAN REVIEW (CASE NO. ZON2003-00126): 1 Narcissa Drive / Pinkham (KF)

Request: A request to approve various walls, fences, solid gates, pilasters and hardscape within the front and street-side setback areas and the intersection visibility triangle of the property at the northeast corner of Narcissa Drive and Palos Verdes Drive South in the Portuguese Bend community. The fence along the front property line (Palos Verdes Drive South) and within the intersection visibility triangle would be 5 to 6 feet tall. The pilasters, solid gates and fence along the street-side property line (Narcissa Drive) in front of the house and within the intersection visibility triangle would be 5 to 10 feet tall. The solid wall along the street-side property line (Narcissa Drive) to the rear of the house would be 8 feet tall.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2005-__, conditionally approving the requested Variance, Minor Exception Permit and Site Plan Review (Case No. ZON2003-00126)

4. HEIGHT VARIATION, SITE PLAN REVIEW (CASE NO. ZON2003-00059): 38 Cinnamon Lane / Seigel, Friend (BY)

4A. P.C. RESOLUTION NO. 2005

Request: Revocation of Height Variation and Site Plan Review Case No. ZON2003-00059 Pursuant to Section 17.86.060(D) of the City’s Development Code.

Recommendation: Staff recommends that the Planning Commission adopt Resolution No. 2005-__; revoking the Height Variation and Site Plan Review Case No. 2003-00059.

5. CONDITIONAL USE PERMIT (CASE NO. ZON2004-00613): 29601 Western Ave / Rio Restaurant (ES)

5A. P.C. RESOLUTION NO. 2005

Request: A request to conduct dancing and live entertainment in the form of Samba dance shows and amplified music with a band during evening hours, in conjunction with an existing Brazilian restaurant.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2005-__, conditionally approving the requested Conditional Use Permit (Case No. ZON2004-00613).
