2b. Staff Report -March 22, 2005

Request: A request to demolish an existing one-story residence, and construct a new 5,182 square foot three-story residence measuring 30-feet in overall height. A total of 40 cubic yards of grading is proposed to accommodate construction of the new residence, and a variance is requested to maintain the existing 17-foot front yard setback since the City’s Development Code requires a 20-foot front yard setback.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2005-__, conditionally approving Case No. ZON2003-00465, for a Variance, Height Variation and Grading Permit.

3. CODE AMENDMENT (CASE NO. ZON2004-00265): CITY (DB)

Request: A request to amend the Development Code to regulate the use of cargo containers.

(This item was continued from the September 14, 2004, November 9, 2004, January 11, 2005, and February 8, 2005 Planning Commission meetings).

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2005-__, thereby recommending to the City Council that they adopt Addendum No. 12 to Environmental Assessment/Negative Declaration (EA/ND) No. 694 and approve the Code Amendment (Case No. ZON2004-00265) to regulate the use of cargo containers on private property.

4. VARIANCE, HEIGHT VARIATION AND GRADING PERMIT (CASE NO.ZON2004-00451): 48 Rockinghorse Drive / Holguin (ES)

4a. P.C. RESOLUTION NO. 2005

Request: A request to construct a new 4,485 square foot, two-story split-level single-family residence with attached garage on a vacant property. A total of 150 cubic yards of overall grading will be conducted to accommodate the new residence. Lastly, the variance is for the proposed construction over an extreme slope, which is prohibited by the City’s Development Code, and is for the resulting height of the building proposed at 30-feet, where the Development Code restricts height to 26-feet

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2005-__, conditionally approving Case No. ZON2004-00451, for a Variance, Height Variation and Grading Permit.

5. VIEW RESTORATION PERMIT NO. 191: 40 Mustang Road / Stott (JA)

Request: A request to trim and/or remove foliage located at 8 Bronco Drive, in order to restore the view from 40 Mustang Road.

Recommendation: Staff recommends that the Planning Commission accept the applicant’s recent withdrawal of the permit application.

6. CONDITIONAL USE PERMIT (CASE NO. ZON2004-00320): 30940 Hawthorne / California Water Service (DB)

6a. P.C. RESOLUTION NO. 2005

Request: A request to install a whip antenna mounted to the two-story City Hall building. The requested antenna is proposed to extend 8’ higher than the existing building.

Recommendation: Staff recommends that the Planning Commission adopt PC Resolution No. 2005-__; thereby approving, with conditions, the conditional use permit.

7. CODE AMENDMENT (CASE NO. ZON2004-00294): CITY (JR)

7a. ORDINANCE NO.

Request: A request to amend the Development Code to establish regulations and procedures relating to the conservation and management of coastal sage scrub habitat.

Recommendation: Staff recommends that the Planning Commission review the proposed Ordinance and forward it to the City Council with a recommendation of approval.

NEW BUSINESS:

8. GENERAL PLAN CONSISTENCY FINDING: CITY (GP)

8a. P.C. RESOLUTION NO. 2005-

Request: A request to find that the City's acceptance of the "Additional Non-Golf Setback" areas within the boundaries of the Trump National Golf Course will be consistent with the City's General Plan.

Recommendation: Staff recommends that the Planning Commission adopt PC Resolution No. 2005-__, finding that the City's acceptance of the "Additional Non-Golf Setback" areas at the Trump National Golf Course is consistent with the General Plan.
