Request: A request to accept the withdrawal of Planning Case No.ZON2004-00638 by the applicant.

Action Deadline: April 30, 2006.

Recommendation: Staff recommends that the Planning Commission accept the withdrawal of Planning Case No.ZON2004-00638 by the applicant.

2. APPEAL OF VIEW PRESERVATION PERMIT NO. 78: Jordan (JA)

Attachment - P.C. RESOLUTION NO. 2006

Request: Appeal of the Planning, Building and Code Enforcement Director’s approval of a request to trim and/or remove foliage located at 29208 Posey Way in order to preserve the view from 6755 El Rodeo Road.

Action Deadline: None

Recommendation: Staff recommends that the Planning Commission adopt PC Resolution No. 2006-___; thereby denying the appeal request and affirming the decision of the Director of Planning, Building & Code Enforcement and approving View Preservation Permit No. 78 upon finding that all applicable findings have been correctly made and all provisions of Section 17.02.040 have been complied with.

3. PROPOSED VIEW RESTORATION AND PRESERVATION GUIDELINE AMENDMENTS: City (JA)

Request: A City-initiated proposal to consider minor revisions to the current View Restoration Guidelines and Procedures in order to update the Guidelines to make them consistent with the November 3, 2004 City Council directive to use a professional mediator and the February 15, 2005 approval of the new fee structure. In addition, Staff proposes minor clean-up amendments to clarify the View Restoration Permit process and conceptually propose streamlining the View Preservation Permit process.

Action Deadline: None

Recommendation: Staff recommends that the Planning Commission review and approve the proposal draft language amendments to the current View Restoration Guidelines and Procedures and forward its recommendation for adoption of the updated Guidelines to the City Council.

Request: A request to demolish an existing Unocal 76 gas station building with service bays and a cashier kiosk, and construct a new 2,754 square foot 7-Eleven convenience store building at a height of 20-feet. The project also includes upgrading the existing fuel dispensers to continue providing 4 fuel pump islands (8 fueling stations); modifying the existing canopy by incorporating a new fascia and tiled pitched roof; a new monument sign, and signage on the building and fascia; new landscaping; a new trash enclosure; and parking.

Action Deadline: August 7, 2006

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2006-__, certifying the Mitigated Negative Declaration; and adopt P.C. Resolution No. 2006-__, conditionally approving Case No. ZON2005-00296 for a Conditional Use Permit Revision, Sign Permit and Site Plan Review.
