APPEAL OF INTERPRETATION PROCEDURE (CASE NO. ZON2007-00253): City’s Coastal Zone/Conroy (ES) Request: A request to overturn the Director’s Interpretation regarding the methodology used in determining the location of the Coastal Setback Line on properties within the Coastal Zone. Action Deadline: None Recommendation: Uphold the Director’s Interpretation that the Coastal Setback Line traverses the property known as 24 Sea Cove Drive 150-feet from the front property line based upon the maps that accompany the report titled, “Geologic Factors Related to a Coastal Set-Back Zone for the City of Rancho Palos Verdes, California” prepared by Earth Sciences Associates (ESA) in 1976 and referenced in the appendix of the City of Rancho Palos Verdes Coastal Specific Plan. (This item was continued from the August 14, 2007 Planning Commission meeting) 3. VARIANCE & COASTAL PERMIT (CASE NO. ZON2007-00046): 24 Seacove Drive / Conroy (ES) Request: A request to allow an after-the-fact swimming pool and spa, an outdoor fireplace and trellis in the rear yard area of the property, within the Coastal Structure Setback Zone at 24 Sea Cove Drive. Action Deadline: March 24, 2009 Recommendation: Staff recommends that the Planning Commission, a) continue discussing the merits of Case No. ZON2007-00046, the Variance and Coastal Permit applications for the after-the-fact work; b) formulate a decision; and, c) direct Staff to prepare the appropriate Resolution for consideration at the next scheduled Planning Commission meeting. (This item was continued from the December 11, 2008 Adjourned Planning Commission meeting) PUBLIC HEARINGS: 4. ZONE TEXT AMENDMENT FOR CONDITIONAL USE PERMITS IN THE CL ZONE: City/ Citywide (ES) Request: A request to amend Chapter 17.14 of Title 17 of the City’s Municipal Code pertaining to permitted and conditionally permitted uses in the Commercial-Limited (CL) Zoning District. The current Code identifies uses that are permitted and uses that are conditionally permitted within the CL Zoning District. The proposed Code Amendment will change this section to require a conditional use permit for all uses identified in the CL Zoning District. Action Deadline: None Recommendation: 1) Review the proposed amendments to Chapters 17.14, 17.16 and 17.20 of Title 17 of the City’s Municipal Code which are necessary to implement the City Council’s directive to require a conditional use permit for all uses in the Commercial Limited (CL) Zoning District; and, 2) If the proposed amendments are acceptable, adopt P.C. Resolution No. 2009-__, recommending that the City Council amend Chapters 17.14, 17.16 and 17.20 accordingly. NEW BUSINESS: 5. ENCROACHMENT PERMIT (CASE NO. ZON2009-00051): 5 Packet Road /Chhabria (LM) Request: A request to allow the after-the-fact construction of a 36” tall retaining wall to encroach 12’-0” into the public right-of-way along the north side of the driveway approach and allow a concrete drainage swale to encroach 12’-0” into the public right-of-way. Action Deadline: April 17, 2009 Recommendation: Adopt P.C. Resolution No. 2000-__; thereby conditionally approving the Encroachment Permit (Case No. ZON2009-00051). 6. ANNUAL REPORT ON THE IMPLEMENTATION OF THE HOUSING ELEMENT: City/Citywide (LM) Request: Review the Housing Element Annual Report regarding the status of the City’s General Plan Housing Element and the progress on its implementation for the 2008 calendar year. Action Deadline: April 1, 2009 Recommendation: Direct Staff, via Minute Order, to forward the City’s Annual Report to the City Council. 7. ANNUAL REPORT ON THE IMPLEMENTATION OF THE GENERAL PLAN: City/Citywide (LM) Request: Review the General Plan Annual Report regarding the status of the General Plan and the progress on its implementation for the 2008 calendar year. Action Deadline: April 1, 2009 Recommendation: Direct Staff, via Minute Order, to forward the City’s Annual Report to the City Council. APPROVAL OF MINUTES: 8.
