1. ZONE TEXT AMENDMENT – FENCES, WALLS AND HEDGES: City/Citywide (AH)

Request: A Code Amendment to revise RPVMC Section 17.76.030 (Fences, Walls and Hedges) to require new fences, walls and hedges within specified setbacks be subject to a Fence, Wall and Hedge Permit, thereby affording view protection from said fences, walls and hedges to more property owners, as well as minor clean-up amendments to Section 17.76.030 to clarify combination hedge heights and applicability of a Minor Exception Permit for fences.

Recommendation: Staff recommends that the Planning Commission:

1.)Review Staff’s proposed code amendment language that would: (a) revise RPVMC Section 17.76.030(B)(1) to require the approval of a Fence, Wall and Hedge Permit for any new fence, wall or hedge within any rear or side yard setback; (b) revise RPVMC Section 17.76.030(C)(1)(b)(iv) to clarify the existing height limitations applicable to combination walls/hedges; and, (c) revise RPVMC Section 17.76.030(D)(1)(a) to clarify that a Minor Exception Permit is not required for any fence higher than 42 inches up to 6 feet within the street-side setback (Case No. ZON2012-00346); and

2.) Provide feedback to Staff on the proposed code amendment and continue the Public Hearing to June 28, 2013 for Staff to come back with finalized language in the form of a resolution for adoption.

2. ZONE TEXT AMENDMENT – ARTERIAL FENCES AND WALLS: City/Citywide (AH)

Request: A Code Amendment to amend RPVMC Section 17.76.030(E) to require consistency between walls or fences that are being repaired or replaced and the pre-existing wall or fence.

Action Deadline: November 6, 2013

Recommendation: Staff recommends that the Planning Commission:

1.) Review Staff’s proposed code amendment language that would require privately owned rear or street side yard walls or fences that need to be repaired and/or replaced by the property owner to match the pre-existing uniform tract perimeter wall or fence that abuts the adjoining arterial street (Case No. ZON2012-00355); and

2.) Provide feedback on the alternatives identified by Staff and continue the public hearing to June 11, 2013 for Staff to come back with finalized language in the form of a resolution for adoption.

3. GENERAL PLAN UPDATE – “DRAFT” LAND USE CHANGE TO ADD THE OPEN SPACE PRESERVE DESIGNATION TO THE TRUMP NATIONAL PROJECT SITE: City (GP/SK)

Request: A request to add the Open Space Preserve land use designation to portions of the Trump National project site.

Action Deadline: None

Recommendation: Approve the proposed land use changes to the General Plan Land Use Map by adding the Open Space Preserve land use designation over portions of the Trump National project site.

4. GENERAL PLAN UPDATE – “DRAFT” LAND USE CHANGES TO MAKE THE URBAN OVERLAY CONTROL DISTRICTS WITHIN THE COASTAL ZONE CONSISTENT WITH THE ZONING MAP AND COASTAL SPECIFIC PLAN LAND USE MAP: City (GP/SK)

Request: A request to add the Urban Overlay Control District over specific properties in the Coastal Zone.

Recommendation: Approve the proposed land use changes to the General Plan Land Use Map by adding the Urban Overlay Control District to specific properties within the Coastal Zone to make them consistent with the same designation that already exists on the same properties on the City’s Zoning Map and Coastal Specific Plan Land Use Map.
