1.A APPEAL OF CASE NO. ZON2001-00213 (Grading & Site Plan Review) Land Owner: Harold Thompson, represented by Forrest Chadwick & John Malony; Appellants: Same; Subject Property: 2700½ San Ramon Drive (Thomas Guide Page 823, F-6).

1B. P.C. RESOLUTION NO. 2003-

1.C CASE NO. ZON2001-00213 (GRADING PERMIT & SITE PLAN REVIEW APPLICATIONS); Applicant: John Maloney, representing landowner Harold Thompson; Address: 2700½ San Ramon Drive.

Request: An appeal of the Director’s decision to deny Case No. ZON2001-00213 for a Grading Permit and Site Plan Review for 505 cubic yards of grading to facilitate the construction of a 2,494 square foot, two-story, single-family residence with detached garage and storage structure on a vacant property.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2003-__, denying without prejudice the appeal, and upholding the Director’s denial of Case No. ZON2001-00213 for a Grading Permit and a Site Plan Review.

2. HEIGHT VARIATION PERMIT (CASE ZON2003-00179): 1917 Trudie Drive / Borg (DB)

Request: A request to demolish an existing residence and construct a new 3,395 square foot two story single-family residence. The proposed residence measures 23.28 feet high, as measured from the lowest finished grade adjacent to the foundation/slab to the highest ridgeline of the residence; and 24.53 feet high, as measured from the highest elevation of building pad covered by structure to the highest ridgeline of the residence.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2003-__; thereby approving, with conditions, the Height Variation (Case No. ZON2003-00179).

3. VARIANCE AND GRADING PERMIT (CASE ZON2003-00247): 30822 Rue De La Pierre / Sartori (RL)

3.B Exhibit "A"

Request: A request for a Variance to consider two existing retaining walls, which are within 3-feet of each other and located at the front of the property, as two separate walls, rather than as a single wall. In addition, the applicant is requesting a Revision to the previously approved Grading permit, to allow the placement of two separate after-the-fact retaining walls measuring 3’-6" and 5-feet, rather than one 8’-6" retaining wall. The total excavation and fill requested is approximately seven (7) feet above and below natural grade.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2003-__, thereby, approving with conditions, the submitted Variance (Case No. ZON2003-00247) and Revision "A" to Grading permit (Case NO. ZON2002-00062).

4. HEIGHT VARIATION PERMIT—APPEAL (CASE ZON2003-00009): 6937 Vallon Drive / Lee (Appellant) (BY)

Request: An appeal of the Planning Director’s approval to allow the construction of a 412 square foot first-story addition and the construction of a 344 square foot second-story addition to an existing single-family residence, at a height of 19’, as measured from the point where the lowest foundation meets finished grade, and 18.10’, as measured from the highest grade covered by structure to the highest ridge.

Recommendation: Staff recommends that the Planning Commission consider the Appellant's continuance request and if the appeal hearing is held as scheduled, adopt P.C. Resolution No. 2003-__, denying the appeal, and upholding the Planning Director’s approval, with conditions, of Height Variation Case No. ZON2003-00009
