1. REVIEW OF THE CITY'S VIEW RESTORATION GUIDELINES: City (TN)

Request: A Planning Commission request to review the View Restoration Guidelines and Procedures and determine whether any language clarifications are necessary.

(This item was continued from the May 25, 2004 and June 22, 2004 Planning Commission Meetings)

Recommendation: Staff recommends that the Planning Commission review the July 2003 View Restoration Guidelines and Procedures and provide feedback to Staff as to whether any minor language clarifications are warranted.

2. NEIGHBORHOOD COMPATIBILITY CODE AMENDMENT: City (AM)

Request: A request to consider amendments to the current Neighborhood Compatibility requirements based on the one year review of the process and amendments initiated by the City Council.

Recommendation: Staff recommends that the Planning Commission continue the public hearing to the August 10, 2004 Planning Commission meeting.

3. HEIGHT VARIATION PERMIT/GRADING PERMIT (CASE NO. ZON2002-00507): /(BY)

Request: A request to allow the construction of a new 5,775 square foot two-story single family residence, at a height of 17.95’, as measured from the highest elevation of existing building pad to be covered by the structure (101.05’) to the highest ridge (119.0’), and 24.5’, as measured from the point where the lowest foundation meets finished grade (94.50’) to the highest ridge. The request is also to allow the grading of 1,035 cubic yards of cut to lower the building pad by 4’-7".

Recommendation: Staff recommends that the Planning Commission continue the item to the August 10, 2004 Planning Commission meeting.

4. APPEAL OF SITE PLAN REVIEW (CASE NO. ZON2003-00280): 5 Rockinghorse Road / Castelao (BY)

Request: An appeal of the Planning Director’s approval to allow the construction of 3,174 square feet of first-story additions to an existing single-family residence, at a height of 15.98’, as measured from the point where the lowest foundation meets finished grade (111.97’), and 15.25’, as measured from the highest grade covered by structure (112.70’) to the top of the proposed ridge (127.45’).

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, denying the appeal thereby upholding the Director’s approval, with conditions, of Site Plan Review Case No. ZON2003-00280.

5. HEIGHT VARIATION PERMIT (CASE NO. ZON2004-00164): 5416 Littlebow / Sun (DB)

Request: A request to construct a 1,587 square foot addition to an existing 1,929 square foot residence. The proposed addition, measures 25.11’ high, as measured from the lowest grade adjacent to the building foundation/slab (103.87’) to the highest ridgeline of the residence (128.98’), and 24.33’ high, as measured from the highest elevation of existing building pad covered by structure (104.65’) to the highest ridgeline of the residence.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-___; thereby approving, with conditions, the Height Variation (Case No. ZON2004-00164).

6. HEIGHT VARIATION PERMIT (CASE NO. 2003-00559): 44 Headland / Berman (DB)

Request: A request to modify an approved Height Variation application to allow the construction of a 350 square foot roof deck as part of the new 4,620 square foot singe family residence. The new residence, which is currently under construction, was approved by the Planning Commission under Case No. ZON2002-00593 on February 11, 2003.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-___; thereby approving, with conditions, the Height Variation (Case No. ZON2003-00559).
