NEIGHBORHOOD COMPATIBILITY CODE AMENDMENT (CASE NO. 2004-00331): City (AM) 1A. P.C. RESOLUTION NO. 2004-_ 1B. ADDENDUM NO. 11 TO ENVIRONMENTAL ASSESSMENT Request: A request to consider amendments to the current Neighborhood Compatibility requirements based on the one year review of the process and amendments initiated by the City Council. Recommendation: Staff recommends that the Planning Commission Adopt P.C. Resolution No. 2004-___ recommending to the City Council the adoption of an Ordinance that amends Title 17 of the Citys Municipal Code by establishing exemptions to the Neighborhood Compatibility requirements. (This item was continued from the July 13, 2004, July 27, 2004 and August 10, 2004 Planning Commission meetings) CONTINUED BUSINESS: 2. HEIGHT VARIATION PERMIT/MINOR EXCEPTION PERMIT (CASE NO. 2004-00164): 5416 Littlebow / Sun (DB) Request: A request to construct a 1,587 square foot addition to an existing 1,929 square foot residence. The proposed addition, measures 25.11 high, as measured from the lowest grade adjacent to the building foundation/slab (103.87) to the highest ridgeline of the residence (128.98), and 24.33 high, as measured from the highest elevation of existing building pad covered by structure (104.65) to the highest ridgeline of the residence. The Minor Exception Permit is to allow the addition to encroach 3-11" into the front setback. (This item was continued from the July 27, 2004 Planning Commission Meeting) Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-___; thereby approving, with conditions, the Height Variation and Minor Exception Permit (Case No. ZON2004-00164). RECESS (approximately 8:30 P.M.) PUBLIC HEARINGS: 3. MINOR EXCEPTION PERMIT (CASE NO. ZON2004-00369): 4362 Exultant Drive / Younggren (BY) 3B. Exhibit "A" Request: A request to allow the existing residence, which is under construction, to maintain a nonconforming front and street side setback. The Planning Commission approved Site Plan Review, Height Variation, and Minor Exception Permit Case No. ZON2002-00605 to allow the construction of 1,329 square feet of first-story additions and the construction of a new 755 square foot second-story addition to the existing legal non-conforming single-family residence. The residence has since been demolished by more than 50% and is being rebuilt. The Citys Development Code requires all residential structures which have been demolished by more than 50% to maintain a 10-0" street side setback and a 20-0" front setback. The existing residence is setback 9.7 from the street side property line and 19.3 from the front property line. Recommendation: Staff recommends that the Planning Commission adopt PC Resolution No. 2004-__, approving with conditions Minor Exception Permit Case No. 2004-00369. 4. HEIGHT VARIATION PERMIT/GRADING PERMIT (CASE NO. ZON2004-00140): 3046 Crownview Drive / Ginsburg (ES) Request: A request to demolish an existing one-story residence, and construct a new two-story residence measuring 9,030 square feet (garage included). A total of 924 cubic yards of grading is proposed to accommodate the new two-story residence, which will measure 26-feet in overall height. Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-__, denying Case No. ZON2004-00140 (Height Variation and Grading Permit). 5. REVISION TO GRADING PERMIT (CASE NO. ZON2003-00349): 5251 Rolling Ridge Road / Florance (DB) Request: A request to revise the orientation of the building footprint for an approved 5,482 square foot residence. Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-___; thereby approving, with conditions, the revision to a Grading Permit (Case No. ZON2004-00391).
