Request: A request for after-the-fact approval of 184 cubic yards of grading for 5-foot-tall and 6½-foot-tall upslope retaining walls on the slope in the rear yard, and an 8½-foot-tall downslope retaining wall with a 3-foot-tall balustrade in the front yard.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-__, thereby conditionally approving the requested after-the-fact variance and grading approval (Case No. ZON2003-00611).

Request: Staff requests that the Planning Commission:

1. Review the information provided by Staff regarding the revised Neighborhood Compatibility analysis and the issue of “by-right” height applicable to the subject site and provide Staff with direction on the following issues:

a. Determine whether to accept the Neighborhood Compatibility Analysis presented at the November 14, 2006 meeting or the revised analysis which includes the five (5) homes on Sea Cove Drive and the Villas Apartment buildings presented in this staff report;

b. Determine whether to also pursue the issue of comparing the proposed residences with the Commercial 16’ “by-right” height limit, which is stricter than the residential “by-right” height standard.

2. If all the outstanding issues are addressed to the Planning Commission’s satisfaction, forward a recommendation on the proposed General Plan Amendment, Zone Change, Coastal Specific Plan Amendment, Vesting Tentative Tract Map No. 67532, Coastal Permit, Variance, Mitigated Negative Declaration, Grading Permit Height Variation applications, (ZON2006-00180~182. Lots 3, 4, and 5).

Recommendation: Staff recommends that the Planning Commission forward a recommendation to the City Council to approve the proposed General Plan Amendment, Zone Change, Coastal Specific Plan Amendment, Vesting Tentative Tract Map No. 67532 with ridgeline elevation for each lots, Coastal Permit, Variance, and the Mitigated Negative Declaration; and deny without prejudice, the proposed Grading and Height Variation applications (ZON2006-00180~182, i.e., Lots 3, 4, and 5).

Request: A request to overturn the Director’s approval of a Site Plan Review Permit, which allow for a new 4,280 square foot residence in replacement of the existing, fire-damaged, 3,946 square foot residence.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-___; denying the appeal, thereby upholding the Director’s approval of the Site Plan Review.

4. COASTAL PERMIT, HEIGHT VARIATION & SITE PLAN REVIEW (CASE NO. ZON2006-00168): ----------------(KF)

Request: A request to construct a 502-square-foot 2nd-floor addition and new 1,574-square-foot 3rd-floor living area and 305-square-foot 3rd-floor roof deck on an existing, 2-story residence. The maximum height of the project is proposed to be 29’-10” from the lowest finished grade covered by the structure and 22’-3” from the highest existing grade covered by the structure.

Action Deadline: January 23, 2007

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-__, denying with prejudice the requested Coastal Permit, Height Variation and Site Plan Review (Case No. ZON2006-00168

5. HEIGHT VARIATION PERMIT (CASE NO. ZON2006-00505): 28045 Ella Road/ Rodin (ES)
Attachment: P.C. RESOLUTION NO. 2007

Request: A request to construct a 1,485 square-foot second story addition and a 145 square foot expansion to the first floor. The project will result in a 4,230 square foot, 2-story residence with a maximum overall height of 23’-6” as measured from the lowest finish grade covered by the structure to the highest roof ridgeline.

Action Deadline: January 27, 2007

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-__, denying without prejudice Case No. ZON2006-00505.

6. APPEAL OF FENCE, WALL & HEDGES PERMIT (CASE NO. ZON2006-00478): 5962 Flambeau / Peppard (SK)
Attachment: P.C. RESOLUTION NO. 2007

Request: A request to overturn the Director’s approval of a Fences, Walls, and Hedges Permit, which allows a 6-foot tall wall along the rear (south) property line, near the top of the slope.

Action Deadline: None

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-___; modifying the Director’s approval of the Fences, Walls, and Hedges Permit by requiring that the proposed 6-foot wall be lowered to a maximum height of 5 feet.

7. CONDITIONAL USE PERMIT (CASE NO. 2006-00159): 28041 Hawthorne Blvd./MMI Titan for Cingular Wireless (KS)

Request: A request to construct telecommunication antennae atop the existing roof.

Action Deadline: February 7, 2007

Recommendation: Staff recommends that the Planning Commission accept the applicant’s request to withdraw the application.
