Request: A request to allow after-the-fact construction of a new combination wall along the east street side yard of an existing single-family residential lot. The retaining portion of the wall ranges in height from 2’-11” at the south end to 4’-8” at the north end of the wall. The overall height of the wall, including the retaining portion, ranges from 7’-1” at the south end to 8’-10” at the north end. The applicant is also requesting approval of a Variance to allow approximately 72% of impervious surface within the front and street side yard setback (maximum of 50% impervious surface, per development code Section 17.48.030.D).
Action Deadline: January 26, 2007
Recommendation: Adopt P.C Resolution No. 2007-___, denying with prejudice the requested Variance and conditionally approving the requested Grading Permit (Case No. ZON2006-00490).
2. HEIGHT VARIATION PERMIT (CASE NO. ZON2006-00410): 8 Toprail Lane / Donnelly (KS)
Request: A request to construct a 1,215 square foot one-story addition to an existing 3,385 square foot one-story residence. The proposed project will measure 19.04’, as measured from the highest point on the existing grade to be covered by the structure (499.00’) to the ridge (518.04’), and 21.02’ as measured from the lowest finish grade elevation to be covered by the structure (497.02’) to the ridge.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-__, thereby conditionally approving the Height Variation Permit (Case No. ZON2006-00410).
Request: A request to demolish the existing 661 square foot vacant office building and construct a three-story single-family residence measuring 1,864 square feet. The Variance is requested for the following: the 26’-2¼” high structure, which exceeds the 26’ height limitation; reduction of the side yard setback from 5’ to 3’; reduction of the front yard setback from 20’ to 5’; an increase of lot coverage from 45% (maximum allowable) to 72%. Height Variation application is requested for the proposed structure which exceeds 16’ in height. Grading application is requested to conduct 148 cubic yards of excavation on-site.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-__, thereby denying without prejudice, the Height Variation Permit, Grading Permit, and Variance (Case No. ZON2006-00481).
Request: A request to construct 721-square-foot 1st-story and 1,587-square-foot 2nd-story additions to an existing 1-story residence. The maximum height of the project is proposed to be 26’-0” from the lowest finished grade covered by the structure and 24’-3” from the highest existing grade covered by the structure.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2007-__, conditionally approving the requested height variation and site plan review (Case No. ZON2005-00647).
