Request: A proposal to change the site’s General Plan Land Use Designation from Commercial Recreational (CR) to Single- Family Residential, two-to-four dwelling units per acre (RS-4); re-zone the subject site from CR to RS-4; change the Coastal Specific Plan’s primary land use designation of commercial recreation to a primary land use of single-family residential; subdivide the existing 1.42-acre subject lot into five residential lots with a minimum lot size of 10,000 square feet; conduct approximately 4,007 cubic yards of grading to accommodate the construction of five (5) two-story single-family residences. The heights of the proposed five (5) two-story residences range from 24.1’ to 25.4’ high. An approval of a variance is requested to allow the proposed five (5) residential lots to have minimum lot depths ranging from 91’ to 93’, which do not meet the minimum 100’ depth requirement for RS-4 lots.

1. Review the opinion provided by the City Attorney with regards to the appropriate Neighborhood Compatibility analysis and identify the proposed project’s immediate neighborhood and whether the proposed project is compatible with said immediate neighborhood; and

2. Determine whether the proposed residences on Lots 3, 4, and 5 (Height Variation) create significant view impact to surrounding properties; and

3. If all the outstanding issues are addressed to the Planning Commission’s satisfaction, forward a recommendation on the proposed General Plan Amendment, Zone Change, Coastal Specific Plan Amendment, Vesting Tentative Tract Map No. 67532, Coastal Permit, Variance, Mitigated Negative Declaration, Grading Permits and Height Variation applications to the City Council.

5. VARIANCE PERMIT (CASE NO. ZON2006-00510): 6521 Via Lorenzo / Jerry Rodin (SK)

Request: A request to demolish the existing non-conforming, detached 324 square-foot garage and construct a new 392 square-foot detached garage in its place. The existing garage is non-conforming because it has a 1’-3” setback to the rear property line, wherein a 15-foot setback is required. The proposed new garage requires a Variance due to a reduced rear yard setback of 5 feet instead of the minimum required setback of 15 feet. The proposed maximum height of the new garage is 12’-8” as measured from the point where the lowest foundation or slab meets finished grade, to the ridgeline or highest point of the structure.

Action Deadline: July 6, 2007

Recommendation: Notwithstanding the applicant’s request for continuance, adopt P.C. Resolution No. 2007-__, thereby approving Variance (Case No. ZON2006-00510) provided that the Planning Commission does not request any changes to the proposed conditions or the project. If changes are requested, continue the item to the April 24, 2007 Planning Commission meeting, to allow the applicant to be present.

6. VARIANCE, GRADING PERMIT & SITE PLAN REVIEW (CASE NO. 2006-00509): 4204 Miraleste Drive / Bartz Design (SK)

Request: A request for a 1,412.17 square foot addition to the upper and lower floor of the existing two-story residence. The request also includes a 73.7 square-foot roof deck and a 116.2 square foot balcony to the rear of the residence. Furthermore, 525.6 cubic yards of grading is proposed to accommodate the addition and retaining walls at a maximum height of 5 feet in the rear yard. The proposed height of the overall structure is 32.64 feet, as measured from the point where the lowest foundation or slab meets finished grade, to the ridgeline or highest point of the structure. A Variance is required since the proposed height exceeds the maximum allowed 30 feet for downsloping lots, as measured from the point where the lowest foundation or slab meets finished grade, to the ridgeline or highest point of the structure.

Action Deadline: April 6, 2007.

Recommendation: Adopt P.C. Resolution No. 2007-__, thereby approving the Variance, Site Plan Review and Grading Permit (Case No. ZON2006-00509).

7. APPEAL OF GRADING PERMIT (CASE NO. 2005-00524): 20 Martingale Drive / Ray (KF)

Request: A request to overturn the Director’s approval of an after-the-fact grading approval application with conditions requiring the removal of one (1) of three (3) non-permitted downslope retaining walls and partial restoration of the pre-construction grade, but to instead grant, as constructed, after-the-fact approval of 627 cubic yards of grading and three (3) downslope retaining walls in the rear yard of a single-family residence.

Action Deadline: None.

Recommendation: Adopt P.C. Resolution No. 2007-__, denying the appeal and upholding the
Director’s approval of the after-the-fact grading permit with modifications (Case No. 2005-00524).

The generator has a built-in fuel tank with a capacity of two hundred fifty (250) gallons. The generator would encroach upon the required 20-foot setback from non-residential properties and 100-foot setback from residential properties for properties located in the CR zoning district. Furthermore, the generator would be located seaward of the coastal setback line established by the City’s Coastal Specific Plan.
