Recommendation: Grant a one-time, one-year extension of the approval of the Coastal Permit, Height Variation and Site Plan Review for the property at -------------------------(Case No. ZON2006-00168) via Minute Order, thereby setting the final expiration date as April 10, 2009, with all conditions of approval remaining in full force and effect.

Request: A request to amend the City’s Zoning Code to implement the recommendations of the City’s Residential Development Standards Steering Committee, and other miscellaneous Zoning Code “clean-up” amendments.

(This item was continued from the February 12, 2008 and March 11, 2008 Planning Commission meetings)

Recommendation: Review and provide direction regarding the code language and zoning map changes presented at the February 12, 2008, and March 11, 2008, Planning Commission meetings; receive the recommendations of the Residential Development Standards Steering Committee regarding parking and driveway standards for future discussion; and continue the public hearing in this matter to May 13, 2008.

Request: A request to approve a 27-unit, 3-story condominium complex with surface and subterranean parking; 12,588 cubic yards of related grading; and the annexation and rezoning of a 440-square-foot portion of the 1.250-acre project site that currently lies within the City of Rolling Hills Estates.

Recommendation: Receive Staff’s presentation and recommendation of conditional approval of all project components except the roof-access stair tower; open the public hearing and receive testimony from the applicant and interested parties; and continue the public hearing to May 13, 2008, to allow Staff to respond to all comments on the Mitigated Negative Declaration and prepare appropriate resolutions.

6. AFFORDABLE HOUSING CODE AMENDMENT (CASE NO. ZON2008-00161): Citywide / City (GP & ES)

Request: A request to amend Chapter 17.11 (Affordable Housing) and Chapter 17.96 (Definitions) of Title 17 of the City’s Municipal Code to conform with the state legislature’s revisions to certain provisions of Government Code Section 65915 that pertain to density bonuses, incentives, and concessions provided to developers for the production of affordable housing. Additionally, the proposed project includes an amendment to Chapter 17.11 (Affordable Housing) of Title 17 of the City’s Municipal Code to implement the following Council policies: 1) Provide a stronger message to developers that affordable housing units be constructed on the project site as opposed to off-site; 2) That the City has the discretion to approve or disapprove the location of any proposed off-site affordable housing units required through the inclusionary program based upon specific criteria, including but not limited to a “not to exceed” maximum percentage of affordable units per existing development; 3) Establish a procedure wherein the City will determine if a developer, which proposes to provide affordable housing units off-site as part of their inclusionary housing obligation, may be permitted to convert existing market rate housing units to affordable units or shall be required to construct new units; and, 4) Establish a standard that any proposal to convert existing market rate housing units to affordable units be applied to all types (single-family detached, condominium, townhome, rental apartments) of available housing.

Recommendation: Adopt P.C. Resolution No. 2008-__, recommending that the City Council certify a Negative Declaration for the project; and Adopt P.C. Resolution No. 2008-__, recommending that the City Council approve a Code Amendment that revises Municipal Code Chapter 17.11, "Affordable Housing", and Chapter 17.96, “Definitions”.
