Request: A request for a one-time, one-year extension of the approval of a Height Variation and Grading Permit, thereby setting the final expiration date as June 10, 2010.

Recommendation: Grant a one-time, one-year extension of the approval of a Height Variation and Grading Permit for the property located at 5338 Bayridge Road (Case No. ZON2008-00193) via Minute Order, thereby setting the final expiration date as June 10, 2010, with all conditions of approval remaining in full force and effect.

Request: A request to find the City’s purchase of a vacant 0.64-acre lot on Cherry Hill Lane in the Portuguese Bend community for public infrastructure, park and trail purposes consistent with the Rancho Palos Verdes General Plan.

Recommendation: Adopt P.C. Resolution No. 2009-__, thereby finding the City’s purchase of the property at 43 Cherry Hill Lane consistent with the General Plan.

5. DENSITY BONUS CODE AMENDMENT (CASE NO. ZON2009-00125): Citywide / City (ES)

Request: A request to amend Chapter 17.11 (Affordable Housing) and Chapter 17.96 (Definitions) of Title 17 of the City’s Municipal Code to conform with the state legislature’s revisions to certain provisions of Government Code Section 65915 that pertain to density bonuses, incentives, and concessions provided to developers for the production of affordable housing.

Recommendation: Adopt P.C. Resolution No. 2009-__, recommending that the City Council certify a Negative Declaration for the project and approve a Code Amendment that revises Municipal Code Chapter 17.11, "Affordable Housing", and Chapter 17.96, “Definitions”.

CONTINUED BUSINESS:

6. MARYMOUNT COLLEGE FACILITIES EXPANSION PROJECT (CASE NO.ZON2003-00317 / CONDITIONAL USE PERMIT NO. 9 - REVISION ‘E’, GRADING PERMIT & VARIANCE): 30800 Palos Verdes Drive East / Marymount College (AM)

Request: A request to modernize the existing campus by demolishing 7 of the 13 existing buildings, expanding 4 of the existing buildings (14,916 square feet), constructing 6 new buildings including a new library, athletic building and two resident hall buildings (121,092 square feet), relocating and reconfiguring the recreational facilities, expanding the parking area (for a total of 463 off-street parking spaces), reconfiguring the entry drive, and constructing various on-site improvements. Additionally, the applicant proposes to conduct 102,000 cubic yards of earth movement (51,000 cubic yards of cut and 51,000 cubic yards of fill) that will be balanced on-site. The proposed Project would occur entirely within the boundaries of the existing 24.57-acre campus. No change to the College’s existing academic operation or student enrollment limit is proposed under the current development application.

Recommendation: Staff recommends that the Planning Commission:

1. Review the findings for the remedial grading on the southern slope proposed to remove the band of extreme slope and un-compacted fill;

2. Adopt P.C. Resolution No. 2009-__, certifying the project’s Environmental Impact

Report pursuant to the California Environmental Quality act with a Mitigation Monitoring and Reporting Program and a Statement of Overriding Considerations; and,

3. Adopt P.C. Resolution No. 2009-__, approving, with conditions, the requested planning applications allowing the construction of the revised Marymount College Facilities Expansion Project.
