Request: A request to construct a new 50 square foot first story addition and a new 1,310 square foot second story addition to an existing single-story residence. The residence will result in an overall height of 23’-9”. A Minor Exception Permit is required to maintain the existing 4’-9” non-conforming south side yard setback.

Action Deadline: October 22, 2009

Recommendation: Adopt P.C. Resolution No. 2009-__; thereby approving, with conditions, a Height Variation and Minor Exception Permit (Case No. ZON2009-00048).

Request: A request to develop a new, 5,759-square-foot veterinary hospital (“Point Vicente Animal Hospital”) and conduct 6,850 cubic yards or related grading on a vacant lot at 31270 Palos Verdes Drive West; and to revise Conditional Use Permit No. 118 for St. Paul’s Lutheran

Church at 31290 Palos Verdes Drive West to reduce the number of off-site parking spaces for the church to be provided on the site of the proposed veterinary hospital from fifty (50) spaces to thirty-two (32) spaces.

Action Deadline: January 20, 2010

Recommendation: 1) Adopt P.C. Resolution No. 2009-__, thereby certifying the Mitigated Negative Declaration; and 2) adopt P.C. Resolution No. 2009-__, thereby conditionally approving the Conditional Use Permit, Grading Permit, Variance and Sign Program (Case No. ZON2008-00505) for the Point Vicente Animal Hospital; and the Conditional Use Permit Revision (Case No. ZON2009-00158) for the St. Paul’s Lutheran Church off-site parking modification.

4. APPEAL OF SPECIAL USE PERMIT (CASE NO. ZON2009-00033): 27501 Western Avenue / Green Hills Memorial Park (AH)

Request: A request to amend the Director’s conditional approval of a Special Use Permit, to allow two (2) temporary modular buildings to continue to be used on the subject property for an additional six (6) years.

Action Deadline: None

Recommendation: Deny the Appeal, thereby upholding the Director’s approval of a Special Use Permit to allow two temporary modular buildings to continue to be used on the subject property for an additional three (3) months.

5. INTERPRETATION HEARING REQUEST (CASE NO. ZON2009-00146): 6001 Palos Verdes Drive South and Residentially Zone property Citywide / Requestor: Gary Weber, representing York Point View Properties (ES)

Request: A request to conduct a hearing on an interpretation issued by the Director whereby a determination was made that a Conditional Use Permit application cannot be accepted for use of Residentially Zoned property to conduct a commercial enterprise whereby Residentially zoned property is used by a person or organization that is not the property owner for the purpose of conducting events, meetings, parties or other similar activities on an on-going commercial basis; rather, a Special Use Permit can be submitted for each proposed “Event Garden” use as they occur.

Recommendation: Adopt P.C. Resolution No. 2009-__, upholding the Director’s Interpretation that the leasing of Residentially zoned property to outside private entities to conduct private parties, weddings, receptions, charity events and the like is not a use allowed by right or by approval of a conditional use permit.
