POINT VIEW MORATORIUM EXCLUSION REQUEST

The subject property, known alternately as “Point View” or “Lower Filiorum,” is located along the south-central coastline of the City at 6001 Palos Verdes Drive South.  The subject property is approximately 95 acres in area, and is designated by the City’s Land Use Policy Map and Zoning Map for single-family residential use at densities of 1 to 2 units per acre.  The site is bordered by Wayfarers Chapel on the east, single-family residential neighborhoods (Portuguese Bend and Upper Abalone Cove) to the north and west, and Palos Verdes Drive South and the City’s Abalone Cove Beach Park to the south.  Approximately 60 acres of the site are located within the City’s Landslide Moratorium Area (LMA), with the remaining 34 acres outside of the LMA and, therefore, not subject to the development restrictions imposed upon undeveloped property.  The site is subject to the development standards and performance criteria established by the Urban and Natural overlay control districts, and is also adjacent to the City’s proposed NCCP Preserve, with portions of the property to be dedicated to the Preserve post-development.  However, the subject property is not within the City’s Coastal Specific Plan district.

The original application for Moratorium Exclusion No. 10 and Environmental Assessment No. 684 was submitted to the City on May 17, 1996, requesting the exclusion of up to 60 acres of the Point View property from the City’s Landslide Moratorium Area.  For the next several years, the application remained incomplete as the property owner, York Long Point Associates (YLPA), prepared the geologic and geotechnical studies in support of the requested moratorium exclusion.  The original application for Moratorium Exclusion No. 10 was deemed complete on December 18, 2001, but YLPA subsequently submitted a revised application to the City on February 27, 2003.  The geologic and geotechnical studies for the proposed moratorium exclusion were conceptually approved by the City’s geotechnical consultant on March 3, 2003, and the revised application for Moratorium Exclusion No. 10 was deemed complete on March 26, 2003.

The City determined that the preparation of an EIR was necessary for the proposed Moratorium Exclusion request. On July 15, 2003, the City Council selected PCR Services Corporation as the consultant responsible for preparing the project EIR for the City. The City’s EIR consultant prepared a Notice of Preparation (NOP)/Initial Study for the project, which was circulated for public comment between October 13 and November 12, 2003 and a public scoping meeting was held before the City Council on October 29, 2003.  The City’s consultant then prepared the project Draft EIR, which was circulated for public review between July 6 and September 16, 2005 and a public comment meeting was held before the City Council on September 6, 2005.  The City’s consultant then began working on completing the Final EIR for the project.

On July 6, 2006, the applicant formally submitted a revised project to the City and requested that the processing of their current project and Final EIR be placed on hold. The revised project calls for a reduction of proposed housing units from 84 units to 72 units, and a reduction in the total amount of grading from about 4 million cubic yards to around 770,000 cubic yards.  The reductions are a result of the revised project being limited to outside the boundary of the ancient landslide.  To further validate the location of the ancient landslide boundary, the applicant conducted additional geologic borings throughout the site in 2006 after the gnatcatcher’s breeding season ended in August.  The applicant’s geotechnical firm has been preparing additional geotechnical reports from the new data which will then need to be submitted to the City for review and approval by the City’s Geologist (Zeiser-Kling).  Staff anticipates these reports to be submitted to the City by late 2007.  After the forthcoming geotechnical reports are submitted and reviewed by the City’s geologist, City Staff will determine the appropriate CEQA review process for the revised project.
